About FanstagAI

FanstagAI is a marketing technology platform developed in Malaysia that helps businesses generate user-generated content (UGC) such as reviews, social media posts, and videos through an AI-powered system. Our main product, the AIS (AI Marketing System), enables content creation via QR code scans that direct users to third-party platforms(e.g., Google, Xiaohongshu, TikTok). FanstagAI does not collect, store, or access any personal data from users who scan these QR codes. All reviews and content are submitted directly to the third-party platforms, governed by their own privacy policies.

Use of Services

By using FanstagAI Services, you agree to:

• Use the Services in compliance with all applicable laws of Malaysia, including but not limited to the Communications and Multimedia Act 1998 and the PDPA 2010.
• Use the system for lawful, business-related purposes only.
• Not attempt to reverse engineer, disrupt, or exploit our platform.
• Be responsible for your content and campaign performance if you are a business or merchant user.

We reserve the right to suspend or terminate access if these Terms are violated or if the system is misused.

User-Generated Content

FanstagAI acts solely as a technical enabler, connecting users to third-party platforms where they submit their own reviews or content. FanstagAI does not store, access, or control any personal data submitted during this process. Merchants and businesses using our platform are fully responsible for ensuring compliance with the respective platform’s community standards, guidelines, and local advertising laws.

Data and Privacy Compliance

(PDPA)FanstagAI complies with Malaysia’s Personal Data Protection Act (PDPA) 2010. However, we do not collect or process personal data from consumers or users through the AIS system. All personal data (if any) is collected and managed by the respective third-party platforms.

For merchant users, we may collect limited business information and aggregated analytics (e.g., number of QR scans, campaign activation metrics) strictly for system reporting and support purposes. This data does not include individual user identities. Please refer to our Privacy Policy for further details.

Account Registration (For Business Users)

If you register an account with FanstagAI, you agree to:

• Provide accurate and current business information.
• Keep your login details confidential.
• Take full responsibility for all activities under your account.

We reserve the right to suspend or terminate accounts for misuse or non-compliance.

Intellectual Property

All content, code, software, designs, and branding related to FanstagAI are the intellectual property of YooMedia Group and its affiliated companies. You may not copy, reproduce, or reuse any portion of our materials without prior written permission.

Limitation of Liability

FanstagAI is provided “as is” without any warranty of performance, reliability, or fitness for a particular purpose. We are not liable for:

• Content posted by users on third-party platforms.
• System interruptions due to maintenance, upgrades, or third-party outages.
• Any loss of revenue, data, or goodwill from use of our Services.

Business users are responsible for ensuring that their use of our tools aligns with applicable marketing laws and advertising standards in Malaysia.8. Modifications to Terms  We may revise these Terms periodically to reflect changes in our Services, technologies, or legal requirements. Any updates will be published on our website, and your continued use of the Services constitutes acceptance of the updated Terms.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
